Testimonial and Review Release Agreement

1. Definitions

In this Agreement:

• “Company” means Far Beyond Digital Ltd (trading as Drop Ship Formula).
• “Testimonial” means any written, audio, visual, or recorded review, feedback, endorsement, comment, or statement provided by me about the Company, its services, programmes, or products.
• “Materials” means all media formats in which the Testimonial may appear, including but not limited to websites, social media, advertisements, emails, sales pages, training content, and promotional materials.

2. Grant of Rights (Perpetual and Irrevocable Licence)

I irrevocably grant the Company a perpetual, worldwide, royalty-free, transferable, and sublicensable licence to use, reproduce, publish, display, distribute, edit, adapt, combine, and otherwise exploit my Testimonial, in whole or in part, in any format and for any lawful business purpose, including marketing, advertising, education, and promotion.

This licence does not expire and cannot be withdrawn, cancelled, or revoked for any reason once granted.

3. No Right of Withdrawal or Takedown

I acknowledge and agree that:

• I will not request the removal, deletion, or cessation of use of my Testimonial at any point in the future;
• Any request to withdraw consent, exercise the “right to erasure”, or similar data protection rights shall not apply to the Company’s continued use of the Testimonial under this Agreement;
• The Company is entitled to continue using the Testimonial indefinitely, including in materials already created or published and in future materials.

This clause survives termination of any business relationship with the Company.

4. Waiver of Moral Rights

To the fullest extent permitted by the Copyright, Designs and Patents Act 1988, I irrevocably waive all moral rights I may have in relation to the Testimonial, including (without limitation) the right to be identified as the author and the right to object to derogatory treatment.

5. Editing and Approval

I agree that:

• The Company may edit the Testimonial for clarity, length, formatting, or presentation, provided the meaning is not materially distorted;
• I waive any right to inspect or approve the final version or any subsequent use of the Testimonial.

6. No Compensation

I confirm that:

• I provide the Testimonial voluntarily;
• I am not entitled to any payment, royalties, or other compensation, now or in the future, for the use of the Testimonial.

7. Use of Name and Likeness

I consent to the Company using:

• My first name and last initial;
• My general location (e.g. town or region);
• My voice, image, or likeness (where provided),

in connection with the Testimonial.

The Company is not required to use my full legal name unless separately agreed in writing.

8. Data Protection (UK GDPR)

I acknowledge that:

• The Company processes my personal data in accordance with UK GDPR and its Privacy Policy;
• The legal basis for using my Testimonial is the Company’s legitimate interests in marketing and promoting its business;
• Withdrawal of consent under UK GDPR does not affect the Company’s rights under this Agreement to continue using the Testimonial.

9. Warranties and Confirmations

I confirm that:

• The Testimonial represents my genuine opinions and personal experience;
• I am over 18 years of age;
• I have full authority to grant the rights contained in this Agreement;
• The Testimonial does not infringe the rights of any third party.

10. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction.

11. Acceptance

By submitting my Testimonial, I confirm that I have read, understood, and agreed to the terms of this Testimonial and Review Release Agreement in full.
